These Terms & Conditions apply when you use thaisilkscarves.net and when you buy from Thai Silk Scarf Company Canada, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). By browsing or using this site, or by placing an order, you agree to these terms. Please read them before you order.
Who you are buying from
Thai Silk Scarf Company Canada is a division of Caruso Consulting Co Ltd. We sell online only and have no shop or showroom. Our Calgary address is a registered office, and every scarf is sent from Thailand. Our contact details are at the bottom of this page.
Using this website
We give you a limited, personal permission to use this site to shop with us. You cannot transfer it to anyone else, and we can withdraw it. It does not cover commercial use, or use on behalf of another person or business, unless we have agreed to that in writing first.
When you use this site, you agree that you will not:
- Use it in any way that breaks the law.
- Upload or send anything that contains viruses or other harmful code.
- Post or send anything defamatory, threatening, obscene or discriminatory.
- Post or send anything that breaks someone else's copyright, trademark or other rights.
- Try to get into our systems without permission, or interfere with how the site works.
- Copy, sell or otherwise exploit the site or any part of it without our written permission.
- Give false information or pretend to be someone else.
Our content
Everything on this site, including our name, logo, text, photographs and designs, belongs to us or to the people who license it to us. It is here for your personal, non-commercial use while you shop.
Products & descriptions
We describe every product as accurately as we can, including the cloth it is woven from and its size in centimetres. Cloth varies a little from piece to piece, and colours on a screen can look slightly different from the scarf in your hand.
Prices & discounts
All prices are in Canadian dollars. The total shown at checkout, made up of the item prices and any delivery charge, is what we charge you.
If we find an error in the price of an order you have placed, we contact you before we dispatch it and ask whether you want to go ahead at the correct price.
Discount codes take money off the goods only, never off delivery. The valued-customer code gives 15% off the items in your cart. Free delivery is based on your goods total after any discount.
Ordering
- Your order is an offer. Placing an order is an offer to buy. The contract is made when we dispatch your order.
- Processing. Once your payment has cleared, orders are handled within 24 to 48 hours.
- Your details. Please give us a correct delivery address, email address and phone number. We are not responsible for delays caused by wrong details.
- Orders we cannot accept. We may refuse or cancel an order, for example when an item is out of stock or when we suspect fraud. If we cancel an order you have paid for, we refund you in full.
Cancelling an order
You can cancel an order until it has shipped. Please contact us within 12 hours of ordering, because orders are handled within 24 to 48 hours. There is no charge for cancelling. Once packing and shipping has started, the order can no longer be cancelled and our returns policy applies instead. The detail is on our Refunds & Returns page.
Payment & security
You pay in full at checkout, by card through Stripe Checkout or by PayPal. Your card details go straight to Stripe or PayPal. We never receive or store them.

Your consumer rights
Consumer protection in Canada is set by each province and territory. The consumer protection law of the province or territory where you live applies to your purchase. Nothing in these terms limits any right under that law that cannot be given up. If anything in these terms conflicts with such a right, the right wins.
Limitation of liability
To the fullest extent the law allows:
- Our total liability arising from an order is limited to the amount you paid for the goods in that order.
- We are not liable for indirect or consequential losses, or for loss of profit, data or opportunity.
- We provide the website as it is. We do not promise that it will always be available or free of errors.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude. More detail is on our Limited Liability Indemnity page, which also forms part of these terms.
Governing law
These terms are governed by the law of Alberta and the federal laws of Canada that apply there, and the courts of Alberta can hear disputes about them. This does not take away your right, as a consumer, to rely on the consumer protection law of the province or territory where you live, or to bring a claim there, including in its small claims court.
Changes to these terms
We may change this site and these terms at any time. The version on this page when you place an order is the version that applies to that order.
